Lutz was shot through the hips, [the ball] going in at right hip and I took it out on opposite side of left hip. . . . Shasteen was shot in mouth. The ball passed through into mouth, knocking out 2 front lower teeth. [It then] passed under tongue injuring end of tongue then back through side of mouth down some where in neck. Drs could not locate the ball." The next day he reports that "Lutz remains much the same. Shasteen is reported worse and it is thought he will die tonight." On October 1, "Lutz had his preliminary hearing and was bound over to the Grand Jury with a bond of $10,000, the hearing being before Squire Gearhart." Dr. Hughey had to testify before the Grand Jury on the 22nd and Lutz was indicted the next day "for shooting with intent to kill and placed under a $1000 bond." His diary ends shortly after this. Norman Lutz was found not guilty by a jury in the criminal trial. After this incident, Norman Lutz left the area. Source: Doctor W. F. Hughey's name appears in 1879 as located in Yellow Bud. His office was in the second building south of the Valley House. In his diary Dr. Hughey notes that on November 3, 1902 he "began to build office on my lot today." It is believed this is in reference to the building, still standing, just north of the creek on the west side of State Street on Lot 10. The information in the paragraph is taken from his diary.
